As we all know, breaking up is hard to do. For the average person, it's the only time in our lives when we deliberately say something that makes someone else cry. It's awful. It's horrible.

I am a homeowner and I pay all the bills in my home. I ended things with her and asked her to move out a few times but she refused to. Is there a legal way to do it? Am I able to just move her stuff out when she is out and change the locks? Call landlord and tenant…they know the answers of getting her out legally. Why do people insist on asking Facebook knowitalls? I do know it starts with giving her a letter of eviction and giving her a set number of days in which to move out.

That whole type of situation is just awkward. Get some good advice before doing anything. Is she a tenant? Is she common-law? Once that is defined, your direction becomes clearer. Change the locks. You own the home. Kick her out. If she wants to spend her time and money trying to fight it, let her. I doubt she would win and I doubt she would go through all that time and trouble. Common law is not six months anymore. We were taught in school it was a year guess even our teachers were wrong!

I had to look it up when me and my ex split a few years ago. Common-law is still a status under Federal regulations for tax and social programs. You will need to go to court. In the very least talk to a lawyer. If you put her stuff outside you could face some real consequences.

Call a lawyer! Do not listen to what these people are saying. If she was your live in gf you will be considered common law most likely. To all you Dumbasses quoting Landlord and tenant this and that, this is a situation covered under the Innkeeper act. Keep your shitty advice to yourselves. If you rent out rooms in your private residence where you reside, the Innkeepers Act can be your best friend. Not only does it allow you to evict on the spot when tenants breach the rules, you can call the police and they will helpfully escort the problem individual out!

No 24 hour eviction, no 14 day eviction, no need to go to the Residential Tenancy Dispute Resolution Service, just have them removed by the police. If you are renting out rooms in your home where you live, you need to have a copy of this act so you can know your rights.

Personally I do not understand why you would remain somewhere you are not wanted does she have no pride? But the non emergency line is your best bet when it comes to getting her the hell out. Well…it depends on how long she lived with you. Change all the locks. Send her a text stating what you just did as well as the fact that your no longer responsible for her things, so if she wants them badly enough, she better get there before anyone sees it.

OR, you can take the higher road and not be there when she comes, but you risk her damaging your property…maybe have a surveillance camera set up to catch any criminal behaviour by her now, or in the future. If she refuses to leave and makes any claims to your property or possessions it becomes a civil matter. My ex claimed my possessions as his even my computer which had just my info on it and I could prove mine with things like a password and was told by police I cannot remove it if he claims it I would have to fight him in civil court.

They could just sit there and read a book or text on their phone — not say a word. It would prevent any false accusations of inappropriate treatment, OP. If this woman is crazy enough to not move out under the circumstances you describe, she could also be crazy enough to falsely accuse you of something terrible. You have to follow the rules for evicting her like a tenant.

Your best bet would be to go in to the Landlord and Tenant building and talk to someone, it is usually faster than calling. Call a lawyer immediately and I would call the police. Give her a written warning to move out as well if need be for evidence.

If she is not on your owership papers. Sounds like she is a squatter. She has no lease or claim to the property. Tell her you had a change of heart and want to take her away for a romantic weekend. Tell her to pack a few things jump in the car with her drive her to someplace remote and drop her off. I would call the police and have her removed. Be sure to copy the note and give her 30 days. She just happens to live there.

You can call the police and have her escorted from the premises. So be careful. I would call the cops and ask them whats legally required. Tell the cops you want her out. Ask them how you do that or ask them to give you the number of a resource that can advise you. Maybe a lawyer? Turf her out legally or she may have grounds to sue. Also note: watch your property. Who has access to your property? A family member broke it off with a woman. He was being nice not heaving her out. While he was at work she came back and took items from his house — including a fridge of all things.

It takes time to be official, income tax etc. I had a similiar situation — if they pay rent, they are a tentant and you can not just change the locks. Nothing the police can do. I chose to change the locks anyway. Worked out pretty good for me. Went through this myself.

Called police and they clarified. You do not have to be married for her to have dower rights. I personally know someone who was the sole person on title who had to pay his girlfriend out at the end of their relationship, they were not married and did not have children and he owned the home before they got together.

I would call a lawyer. Dower rights only apply to married people. She may be entitled to unjust enrichment if anything. After 6 months half of any gains are split both ways — if you want to get really down to it! Dower rights is just the well-known teem. Samantha Street-Jones Although most Provinces have dispensed with dower rights, they remain alive and well in Alberta. Dower rights occur only in marriage — not in common-law. It does not apply to jointly owned assets. A homestead is the home where you and your spouse lived during your marriage.

Common law is absolutely still a term used by the Government of Canada. My fiance and I were considered common-law when we applied for immigration under the government of Canada. Legally you are classed as common law after 12 months co-habiting.

I believe dower rights only apply to Married couples. Common law does not exist in Alberta any longer — it is Adult Interdependent relationships. That comes into effect after 3 years, or if you have children in common, or if you sign an adult interdependent agreement. In any case, consult a lawyer who will give you advice that will save you money in the long run. The police will not remove her, they will tell you to go to court. The best way to do it is change the locks, and put all of her stuff outside.

She will have no grounds for them to let her back into a house she has no claim to…. If there was a lease then she would have to sign a document removing herself from the lease. Call the Residential Tenancy Dispute Resolution Service to get their opinion for your exact circumstance, they are part of the small claims court for landlords and tenants and give great advice that is free You need to evict her as if she is a Tennent.

This depends on whether you have a written lease with the boyfriend or girlfriend. If they have signed a lease, they may only be evicted if they have materially breached the lease—and breaking your heart is not ordinarily a breach of a lease, much less a material one. If they signed a lease, and are in default say for not paying rent , then the landlord can evict them as they would any other tenant in breach of a lease. If there is no lease, the girlfriend or boyfriend is essentially a squatter. Texas does not permit "self-help" evictions, meaning that it is not permissible for you to change the locks and throw all their belongings on the lawn. You must go through the evictions process established by law. Can I evict my girlfriend or boyfriend from the property?

Question: My girlfriend and her son moved into my home in Gilbert three months ago. Almost from the beginning we had problems, and I think it is now best that she and her son move elsewhere. I will help her financially to find a new home. After I discussed this reasonable plan with her, she became very upset and said that she would not move out. What do I do now?

Can I kick out my girlfriend and change the locks?

Things are not working out. You want her to move out. This is a tricky situation that needs to be handled with tact and diplomacy. There may actually be two tasks you must accomplish: breaking up with a girlfriend and evicting her. Even if you do not want to break up with her, you are terminating a part of your relationship and this must be handled with sensitivity. If children are involved you must be sensitive to those needs while still holding boundaries. Although most states only define your girlfriend as your tenant if she has been paying rent, do not assume this is the case. Simply talking to her is the most straightforward, honest approach and the path of least resistance.
